Facing Traffic Charges in Norfolk? Let’s Protect Your Right to Drive

Receiving a summons for a traffic offense in Hampton Roads often feels like a minor inconvenience until you realize the potential long-term impact on your life. Whether it’s a high-speed reckless driving charge on I-64 or a DUI arrest after a night out in Downtown Norfolk, these aren't just "tickets." They are legal hurdles that can jeopardize your employment, your insurance rates, and your freedom.

At The Gregg Law Group, we don't look at you as just another case number on a crowded court docket. We see a neighbor who is navigating a stressful situation and needs a straight answer. With over 20 years of legal experience in the Virginia legal system, including time spent seeing how the prosecution builds their cases, we understand the nuances of the Norfolk General District Court and how to build a defense that stands up to scrutiny.

If you’re ready to discuss your situation with a team that values transparency and aggressive advocacy, call (757) 697-2900 or contact us online for a free consultation.

Why a "Simple Ticket" in Virginia Often Isn't Simple

Many people moving through Norfolk, especially those stationed at the Naval Base or commuting from Chesapeake and Virginia Beach, are surprised by how strict Virginia traffic laws are. Unlike other states where speeding is a mere infraction, certain speeds here carry criminal weight.

We believe that being informed is your first line of defense. When you walk into our office near the Norfolk City Hall Complex, we take the time to break down the specific statutes you’re facing. We want you to understand the "why" behind our strategy, providing a clear roadmap of what to expect in the weeks ahead.

Reckless Driving: More Than Just Speeding

In Norfolk, reckless driving is a Class 1 misdemeanor. It carries the same criminal classification as other serious offenses, including DUI.

A conviction can result in up to:

  • 12 months in jail
  • Fines of up to $2,500
  • Driver’s license suspension of up to six months
  • A permanent criminal record

Under Virginia law, reckless driving by speed can be charged when a driver is going 20 mph or more over the limit, or traveling over 85 mph regardless of the posted limit. However, reckless driving is not limited to speed alone; it can also apply to driving behavior that is alleged to show a disregard for the safety of persons or property under the circumstances.

Driving Under the Influence (DUI) & Refusal

A DUI charge is an immediate crisis for most people. Between the administrative license suspension and the looming threat of mandatory jail time (depending on your Blood Alcohol Content), the stakes are incredibly high.

We handle a wide range of alcohol-related offenses, including:

  • First-offense DUI. Navigating ignition interlock requirements and restricted license petitions.
  • Subsequent DUI offenses. Managing the increased penalties and mandatory minimum jail sentences that come with prior convictions.
  • Underage DUI. Protecting the futures of young drivers who face a "zero tolerance" policy in Virginia.
  • Breathalyzer refusal. Addressing the civil and criminal implications of declining a chemical test at the station.

Our approach involves a meticulous review of the initial traffic stop. Did the officer have reasonable suspicion? Were the Field Sobriety Tests administered correctly? By asking these questions, we aim to provide a robust defense.

Comprehensive Defense for All Traffic Violations

While DUI and reckless driving are the most common high-stakes cases we see, The Gregg Law Group handles the full spectrum of traffic offenses across Hampton Roads. Each carries its own set of risks for your driving record.

The Active Intelligent Speed Assistance (ISA) Program

Virginia law allows courts, in certain serious reckless driving and high-speed cases, to consider an Intelligent Speed Assistance (ISA) requirement as part of sentencing or as a condition of restricted driving privileges. This is generally associated with offenses such as extreme speeding, reckless driving, or street racing, depending on the circumstances of the case.

ISA is not part of the DMV point system and is not used for standard traffic stops or minor infractions. It is a court-ordered condition that may be imposed in qualifying cases.

  • How it works. ISA uses GPS and digital mapping to identify posted speed limits and limits a vehicle’s ability to exceed a set speed threshold while the device is installed.
  • Cost. When ordered by the court, the driver is typically responsible for installation and ongoing program costs.

The The Gregg Law Group Difference: Trial Strength & Integrity

We are prepared to take cases to trial when needed. Our history includes hundreds of jury trials, which means we are always ready to take a case to a judge if a fair resolution cannot be reached through negotiation. Because our team includes former prosecutor insight, we can often anticipate the Commonwealth’s moves before they make them.

A Local Perspective

Our office is located in the heart of Norfolk, just a block from the Civic Plaza Station and across from the Norfolk City Hall Complex. We are part of this community. When we represent you in Portsmouth, Suffolk, or Newport News, we bring a familiarity with local court customs and personnel that only comes from decades of daily practice.

Compassion Meets Advocacy

Legal trouble is heavy. It affects your sleep, your family, and your peace of mind. At The Gregg Law Group, we lead with empathy. You will find that our staff is responsive and that we speak to you in plain English, not "legalese." We want you to feel supported and empowered to make the best decisions for your future.

Transparent Communication

You will never be left wondering what is happening with your case. We pride ourselves on being accessible, offering both in-person and virtual consultations to fit your schedule. We believe that an informed client is a confident client, so we keep the lines of communication open from the moment you retain us until your case is closed.

Take the First Step Toward Resolving Your Case

The clock starts ticking the moment you are handed a summons. In many traffic cases, there are steps we can take early on, such as attending a driver improvement clinic or having your speedometer calibrated, that may positively influence the final result. Waiting until the week of your court date limits our options.

Whether you are a local resident, a member of the military, or a visitor passing through Hampton Roads, we are here to provide the guidance you need.

Contact The Gregg Law Group today by calling (757) 697-2900 to schedule your free consultation. Let’s sit down, look at the facts of your case, and determine the best way to move forward together.
