Voluntary vs. Involuntary Manslaughter in Virginia

Virginia defines manslaughter as causing another person’s death unlawfully and without malice, which separates it legally from murder. Virginia courts have developed these definitions largely through case law rather than a single statute, and the distinctions between charge types carry real consequences at sentencing.

Voluntary Manslaughter

Voluntary manslaughter under Virginia Code 18.2-35 applies when a person intentionally causes another’s death in the sudden heat of passion upon reasonable provocation, without malice and without prior planning. A fatal altercation that was not premeditated is a common example. The law recognizes that extreme provocation can remove the element of malice required for a murder charge.

Involuntary Manslaughter

Involuntary manslaughter under Virginia Code 18.2-36 covers accidental killings that result from an unlawful act that isn’t a felony, or from a lawful act carried out with criminal negligence. Discharging a firearm recklessly near a crowd is one scenario that can produce this charge. The key distinction from voluntary manslaughter is that the defendant did not intend to cause death.

Aggravated Involuntary Manslaughter

Aggravated involuntary manslaughter under Virginia Code 18.2-36.1 is a DUI-specific offense. Under subsection A, a death caused by driving under the influence is charged as involuntary manslaughter. Under subsection B, the charge escalates when the defendant’s conduct was so gross, wanton, and culpable as to show a reckless disregard for human life, something beyond impaired driving alone. Virginia also recognizes a parallel offense under Code 18.2-36.2 for deaths caused by operating a watercraft under the influence.

Virginia Manslaughter Penalties

Both voluntary and involuntary manslaughter are Class 5 felonies in Virginia, punishable by 1 to 10 years in prison and a fine of up to $2,500. A judge has discretion to impose up to 12 months in jail rather than a state prison sentence in appropriate cases, and neither offense carries a mandatory minimum under the Class 5 classification.

Aggravated involuntary manslaughter carries significantly higher exposure: 1 to 20 years in prison with a mandatory minimum of 1 year. When the conviction involves driving under the influence, the court can also revoke the defendant’s driver’s license.
