Virginia Rape Law: Charges, Penalties & Registration

Understanding what you’re facing matters. Virginia Code §18.2-61 defines rape as sexual intercourse with another person against their will by force, threat, or intimidation; through the victim’s mental incapacity or physical helplessness; or with a child under the age of 13. The charge is an unclassified felony carrying a sentence of five years to life in prison.

The statute imposes significantly enhanced penalties when the victim is under 13. If the offender was 18 or older at the time of the offense, Virginia Code §18.2-61 requires a mandatory minimum sentence of life in prison. A separate 25-year mandatory minimum applies when the offender is more than three years older than the victim and the rape was committed in connection with offenses such as abduction, burglary, or aggravated malicious wounding. When the sentence imposed is anything less than life, the court must also impose a suspended sentence of no less than 40 years, to remain in effect for the remainder of the defendant’s life. All mandatory minimums run consecutively to any other sentence, and there is no judicial discretion to go below these thresholds.

Sex Offender Registration

A rape conviction in Virginia triggers mandatory lifetime registration on the Virginia Sex Offender and Crimes Against Minors Registry. This is a public, searchable database listing the registrant’s name, address, and offense. Tier III offenders convicted of rape have no path to removal from the registry.

Collateral Consequences Beyond Prison

The impact of a rape conviction extends well beyond incarceration and registration. Additional consequences can include:
