Virginia Drug Trafficking Charges & Penalties

Virginia law draws a clear distinction between drug trafficking and related offenses like possession with intent to distribute (PWID). The difference matters because the penalties are distinct and severe.

Under Virginia Code §18.2-248.01, it is a felony to transport into the Commonwealth with intent to sell or distribute one ounce or more of cocaine or another Schedule I or II controlled substance, or five or more pounds of marijuana. This statute is separate from the manufacture, sale, distribution, and PWID felony under Virginia Code §18.2-248, which also carries five to 40 years for Schedule I or II substances.

The sentencing exposure under §18.2-248.01 is significant:

• First conviction: Five to 40 years with a three-year mandatory minimum, plus fines up to $1,000,000
• Second or subsequent conviction: A mandatory minimum of 10 years, served consecutively with any other sentence

Penalties increase based on the controlled substance type and quantity, prior convictions, and aggravating factors such as proximity to schools or distribution to minors.
